What is the maximum penalty for supply prohibited drug in NSW?
Maximum penalty. On indictment, for less than a commercial quantity: 15 years imprisonment and/or 2,000 penalty units (10 years and/or 2,000 penalty units where the drug is cannabis), s 32(1). If dealt with summarily in the Local Court: capped at 2 years imprisonment and/or 100 penalty units (Table 1), or 2 years and/or 50 penalty units for small-quantity supply (Table 2).
A maximum is the ceiling the law sets for the worst category of case. It is not what a court is likely to impose, and it is not a prediction about any particular matter.
What the charge covers
Supply covers selling or giving a prohibited drug to another person, agreeing or offering to supply it, or possessing the drug for the purpose of supply. No money needs to change hands, and possessing more than the 'traffickable quantity' can trigger a legal presumption that the drugs were held for supply. The maximum penalty depends on the type and quantity of the drug and which court finalises the case.

Indictable; Table offence. Small quantity is Table 2, up to less-than-commercial quantity is Table 1 (usually dealt with summarily in the Local Court unless an election is made; commercial quantity and above is strictly indictable)
