Will I go to jail for driving while disqualified in NSW?
The short answer: Courts see disqualified driving as defiance of a court order, so it is treated more seriously than most traffic offences, and repeat offenders face real custody. First offences with a genuine explanation usually land on fines and further disqualification.

Maximum penalties are the ceiling for the worst category of case, not the likely outcome. Figures general as at publication; confirm current penalties with a lawyer.
What courts actually do
The pattern that leads to custody is repetition. A first offence, honestly explained, is usually dealt with by fine and disqualification. By a second or third, courts start talking about full-time or home detention.
These charges are also more defensible than people assume: the prosecution must prove you knew of the disqualification, and the underlying disqualification itself is sometimes reviewable. We have had a client found not guilty and a prior 11-year suspension annulled in the same matter.
Common questions
I didn't know I was disqualified, is that a defence?
It can be. The prosecution must establish the disqualification and your knowledge of it. Where notice never reached you, that is a genuine issue to run.
Can old disqualifications be removed?
NSW has a scheme for removing long historical disqualification periods for eligible drivers, and prior convictions can sometimes be annulled. We have used both to put clients back on the road lawfully.
